95th Percentile definition95th Percentile is a billing model for certain Services in which the total outbound bytes of Customer content delivered from each Region is determined every five (5) minutes (“95th Percentile”) and each total being a “Sample”. The highest 5% of Samples are discarded, and the remaining Samples will be the “95th Percentile Sample” for that Region and converted to Mbps. Lumen will invoice Customer based on the 95th Percentile Sample at the price set forth in the Order. 95th Percentile billing assumes Customer’s utilization of the CDN Service will not contain any Sample greater than three (3) times the 95th Percentile Sample (“Disproportionate Peak”) where Lumen reserves the right to invoice Customer for all usage that exceed the 95th Percentile Sample using the Actual Usage billing model at a price per- GB transferred equal to 1/32 of the stated price per-Mbps. The top 5% of all samples for each of the inbound and outbound measurements are discarded, and the next highest remaining data sample on the combined inbound and outbound shall represent the 95th Percentile Basis result. This result is used as the basis for computation of any additional charges for that particular month of Service over the minimum committed which shall be billed in arrears. If the 95th Percentile Basis result falls below the monthly minimum committed amount, no additional charges will be assessed. AVT Connect will disregard any data samples with zero inbound or outbound data for the purpose of 95th Percentile Basis calculation. For example: If Client uses AVT Connect‟s services for an event that lasts 3 hours, AVT Connect will calculate 95th Percentile Basis from the 3 hours of Sample Data. This allows Client to use AVT Connect‟s services for short events and yet have a fair pricing for its service. Example: AVT Connect gathers all data samples for the month of Service and sorts the samples from highest to lowest discarding the top 5%.: AVT Connect obtains a sample every 5 minutes, which is the average aggregate utilization of all Client traffic for that 5 minute increment.   • B) Customer’s usage may be measured using either a per gigabyte billing methodology or a 95th Percentile billing methodology.

  • If the Ninety-Fifth (95th) Percentile is greater than the CIR, Customer will, in addition to being billed for the CIR as described in (b) above, be billed for the difference between the CIR and the Ninety-Fifth (95th) Percentile and such difference shall be billed at the price per megabit described in the Agreement multiplied by the number of megabits.
