Both we and sellers process members’ personal information (for example, buyer name, email address, and delivery address) and are therefore considered separate and independent data controllers of buyers’ personal information under EU law. We may terminate or suspend your account (and any accounts Authentic Detective determines are related to your account) and your access to the Digital Properties should we have reason to believe you, Your Content, or your use of the Digital Properties violate our Terms. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Digital Properties, for example, to sell or buy on our websites or mobile apps. Generally, Authentic Detective will notify you that your account has been terminated or suspended, unless you’ve repeatedly violated our Terms or we have legal or regulatory reasons preventing us from notifying you.

If you or Fine D3sign Corp AKA Fine D3sign Corp terminate your account, you may lose any information associated with your account, including Your Content.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend Fine D3sign Corp AKA Fine D3sign Corp (including any of our employees, agent, directors, officers, or shareholders) and hold us harmless from any legal claim or demand (including reasonable lawyer’s fees) that arises from your actions, your use (or misuse) of our Digital Properties, your breach of the Terms, or you or your account’s infringement of someone else’s rights.

We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.

11. Disputes with Fine D3sign Corp AKA Fine D3sign Corp

The following rules will govern any legal dispute involving our Digital Properties:

You understand that by agreeing to the Terms, you and Authentic Detective are each waiving the right to trial by jury or to participate in a class action lawsuit. Class arbitrations shall only be available if requested by either party under its Class Action Arbitration Rules and approved by the arbitration entity. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator or mediator. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis.
3. Costs of Arbitration. Payment for any and all reasonable AAA filing, administrative, and arbitrator fees will be in accordance with the Consumer Arbitration Rules. The parties will pay their share of arbitration costs.

We are not responsible for any losses due to the result of any issued authentication certificate. We are not liable for any losses with chargebacks, credit card companies, PayPal, or the like. Authentic Detective is not responsible for any human error in terms of authentication.
6. Fine D3sign Corp AKA Fine D3sign Corp is not affiliated with any brands that are authenticated. The opinions rendered at Fine D3sign Corp AKA Fine D3sign Corp are based on years of experience. Although our certificate of authenticity will greatly help your chances with third party disputes, they may have guidelines of their own and we can not guarantee a particular outcome. Fine D3sign Corp AKA Fine D3sign Corp is not required to explain any results provided. Clients, users, customers, businesses, and end users may not make Authentic Detective liable for any mistakes regarding authentication. No refunds will be owed under any circumstance unless discussed and agreed with Fine D3sign Corp AKA Fine D3sign Corp .

12. Changes to the Terms

We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by posting the changes through the Digital Properties and/or sending you an email or message about the changes. That way you can decide whether you want to continue using the Digital Properties. Changes will be effective upon the posting of the changes unless otherwise specified. You are responsible for reviewing and becoming familiar with any changes. Your use of the Digital Properties following the changes constitutes your acceptance of the updated Terms.

13. Miscellaneous

Fine D3sign Corp AKA Fine D3sign Corp will not be responsible and will not pay any compensation where we are preventing or delayed from performing our obligations due to an event beyond our reasonable control, including but not limited to flood, earthquake, mechanical breakdown, epidemic, pandemic, IT failure, fire, adverse weather conditions, acts of terrorism, gas, water or other utilities.

We may transfer this agreement to someone else: We may transfer our rights and obligations under these terms to another organization. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

Even if we delay in enforcing this contract, we can still enforce it later: If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

You represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.
