Class X Felony: Types of Crimes and Sentencing Range
Types of Class X Crimes:
Class X felonies include murder, attempted murder, aggravated sexual assault, and armed robbery, to name a few.
Sentencing Range for Class X Felony:
The sentencing on a Class X ranges from 6 years to 30 years. However, if a person is extended range eligible, then the range is from 12 years to 60 years. Extended range eligible means that the person has a prior felony conviction in his or her background.
Is it possible to get less than 6 years on a Class X?
No. If you are looking to get less than a 6 year sentence, you have to have the charge reduced. A Class 1 has a minimum of 4 years, while a Class 2 has a minimum of 3 years. Furthermore, a Class 3 has a minimum of 2 years, and a Class 4 has a minimum of 1 year.
How do you get a different Class so you get less time?
There are two ways to try to get have lessen the charge. First, I will file a motion to have the case dismissed. Second, I will set the case for trial.
These steps will cause the state to understand that you are not going to take whatever they offer.
How is a Class X Felony different from other crimes?
A Class X felony has the potential for a much greater prison sentence. The least amount of time a judge can give you is 6 years. Even if the judge wants to give you probation or less time, he or she cannot. Therefore, if the charge is going to be reduced so you can get less time or even probation, it is the State’s Attorney that has to make the decision to reduce it. By filing motions or setting the case for trial, I usually can convince the State to reduce the charges.
