Section 55 A of Indian Penal Code (IPC) in Hindi and English

55 क. “समुचित सरकार” की परिभाषा -

धारा 54 और 55 में “समुचित सरकार” पद से -

(क) उन मामलों में केन्द्रीय सरकार अभिप्रेत है, जिनमें दण्डादेश मृत्यु का दण्डादेश है, या ऐसे विषय से, जिस पर संघ की कार्यपालन शक्ति का विस्तार है, संबंधित किसी विधि के विरुद्ध अपराध के लिए है; तथा

(ख) उन मामलों में उस राज्य की सरकार, जिसके अन्दर अपराधी दण्डादिष्ट हुआ है, अभिप्रेत है, जहां कि दण्डादेश (चाहे मृत्यु का हो या नहीं) ऐसे विषय से, जिस पर राज्य की कार्यपालन शक्ति का विस्तार है, संबंधित किसी विधि के विरुद्ध अपराध के लिए है।

55 A.- Definition of “appropriate Government” —

In sections 54 and 55 the expression “appropriate Government” means -

(a) in cases where the sentence is a sentence of death or is for an offence against any law relating to a matter to which the executive power of the Union extends, the Central Government; and

(b) in cases where the sentence (whether of death or not) is for an offence against any law relating to a matter to which the executive power of the State extends, the Government of the State within which the offender is sentenced.
