Former Las Vegas Raiders wide receiver and first-round draft pick Henry Ruggs III will remain under house arrest with a continuous alcohol monitor, as well as a GPS monitor after missing a call for a breath-alcohol test required in his drunk driving case. While Ruggs risked returning to jail over the missed prompt, Las Vegas Justice of the Peace Suzan Baucum opted to keep Ruggs on house arrest “with a higher level of monitoring,” according to the Associated Press. Baucum also warned Ruggs any missed tests or proof of alcohol use would “be problematic” moving forward, per the report.

Ruggs was placed on house arrest and required to wear an alcohol monitor and submit to testing four times a day while out on bail. On Nov. 13, Ruggs missed a call at 4:41 p.m. prompting him to submit an alcohol test, which he claims he did not hear a signal for. Ruggs later gave himself a “client-initiated remote breath test” at 6:28 p.m. that same day. Ruggs’ attorneys David Chesnoff and Richard Schonfeld attest their client took the test “out of an abundance of caution” and met the three-hour requirement.

“Henry did the right thing by testing within the window,” Chesnoff said with Ruggs standing before the judge, via AP.” “He should not be punished because his case attracts so much attention.

Since his Nov. 3 release from jail on $150,000 bail, Ruggs has passed more than 77 breath-alcohol tests, his attorney told the judge. Ruggs’ representation also submitted testimonials from two people who claim they were with Ruggs when he missed the call on Nov. 13 and also did not hear a signal.

Ruggs faces two felony charges for driving under the influence after his car struck the back of a vehicle resulting in the death of a 23-year-old woman and her dog. Ruggs was driving 156 mph and had a blood-alcohol level of 0.16 percent, according to prosecutors. Ruggs also faces a felony misdemeanor on a weapon charge after police reportedly found a loaded handgun in his vehicle the night of the incident.

The Raiders, who selected Ruggs with the No. 12 overall pick in the 2020 NFL Draft, released the 22-year-old receiver just hours after the crash.
