Parens patriae definitionParens patriae literally means “parent of his or her country” in Latin, and has been defined as “the state in its capacity as provider of protection to those unable to care for themselves.” Black’s Law Dictionary, supra note 31, at 1221. “This doctrine originated in the ancient duty of the English sovereign to protect all children within his or her realm” and, in the late 1800s, it was the driving factor behind the establishment of juvenile courts in the United States.
