- You may file Form I-140 by mail or, in certain circumstances, you may file online.
If you are filing by mail, visit our Direct Filing Addresses for Form I-140 page to determine where to mail your form and follow the general filing tips on our Tips for Filing Forms by Mail page to ensure that we will accept your Form I-140 for processing.
You can only file online if you are submitting a standalone Form I-140 without any other form (except Form G-28 if filing with an attorney or accredited representative).
If you are submitting Form I-140 together with another form, including Form I-907, you must file by mail. Form I-907 may still be filed by mail to request premium processing after you file your Form I-140 online. You cannot file Form I-485 online at this time. Do not upload Form I-485 with Form I-140, including as supporting evidence. We will not accept or adjudicate any Form I-485 included as supporting evidence with a Form I-140 that was filed online.
Below are some filing tips for Form I-140:
- Use the current version of the form, which you can find on our Form I-140 page.
- Make sure the petitioner signs the form, or we will reject the form.
- If you are submitting Form I-140 together with another form, including Form I-907, you must file by mail. If you submitted a Form I-140 online, you may still separately file Form I-907 by mail to request premium processing for the electronically filed Form I-140.
- If you submit Form I-907, Request for Premium Processing Service, with Form I-140, you must follow the Form I-907 instructions and:
- Pay each filing fee separately. If you submit a single, combined fee payment for these two forms, we will reject the entire package.
- Include only one Form I-907 for the associated Form I-140. Do not submit multiple Forms I-907 for the same Form I-140 or for other unrelated Forms I-140 which you might have submitted separately.
- File Form I-907 together with Form I-140 by mail.
- If the petitioner is represented by an attorney or accredited representative, the Form I-140 petition must be accompanied by a Form G-28, Notice of Entry of Appearance as Attorney or Representative, with original signatures.
- If the beneficiary may be entitled to an earlier priority date based on a previously approved Form I-140, please provide a statement requesting the earlier priority date and include a copy of Form I-797, Notice of Approval, for the previous Form I-140.
Completing Form I-140
- Make sure to provide the petitioner’s (not the attorney’s) contact information in Part 1.
- Select only one visa preference category in Part 2. We will reject your form if you leave Part 2 blank or if you select more than one category.
- If the beneficiary will be placed at a client site, please identify the address of the client location in Part 6.
- If Part 2 indicates that the petition is being filed for an alien of extraordinary ability or a National Interest Waiver, please include information in Part 6. At a minimum, please complete: 1. Job title; 2. SOC code; and 3. Nontechnical description of the job. We need this information to verify the beneficiary’s/self-petitioner’s proposed endeavor or how they intend to continue to work in the United States in their area of expertise.
