Massachusetts Notary Requirements and Information

Massachusetts Notary Commission Qualifications Notary applicants must: • be at least 18 years old; • reside in Massachusetts or conduct business on a regular basis in Massachusetts.

Appointing Officer • Governor - appoints notaries. • Secretary of State - maintains records.

Term of Office 7 year term.

Notary Education and/or Exam Requirement Not required.

Notary Bond Requirement Not required.

Notary Recordbook (Journal) Requirement Recordbook (journal) required. Only one active journal at a time. Chronological, permanently bound book with numbered pages or sequentially numbered entries. Exempted are attorney-Notaries Public admitted to practice law in any jurisdiction; and Notaries who are employed by an attorney and who perform notarizations “by virtue” of such employment; and government-employee Notaries (for the notarial acts performed in the government-employee Notary’s course of employment).

Notary Seal Requirement Ink stamp or embossing seal required, paper notarial acts. Black ink specified for stamp. Ink stamp and embossing seal may be used together to satisfy statutory requirements regarding information elements to be included in the official notarial seal.

Authorized Duties • Oaths/affirmations; • acknowledgments; • execute jurats; • witness signatures; • certify copies; • issue summonses for witnesses; • issue subpoenas; • witness the opening of bank safes, vaults or boxes.
