What Does a District Attorney Do?
He is to judge between the people and the government; he is to be the safeguard of the one and the advocate for the rights of the other; he ought not to suffer the innocent to be oppressed or vexatiously harassed, any more than those who deserve prosecution to escape; he is to pursue guilt; he is to protect innocence; he is to judge the circumstances, and, according to their true complexion, to combine the public welfare and the safety of the citizens, preserving both, and not impairing either; he is to decline the use of individual passions and individual malevolence, when he can not use them for the advantage of the public; he is to lay hold of them where public justice, in sound discretions, requires it.

In Tennessee, District Attorneys General are elected by the citizens of their judicial districts to serve a term of eight years. They are responsible for the prosecution of criminal cases on behalf of the state, but ultimately their day-to-day responsibilities include so much more.

They advocate for victims to ensure their constitutional rights are protected and assist them in navigating the criminal justice process. They partner with treatment centers, nonprofits and support services throughout their communities in an effort to prevent crime. They advocate and defend our most vulnerable populations, such as elders and children. And last but not least, they oversee the administrative needs of their offices to ensure their teams are equipped with the training, support and resources they need.

  • Holding defendants accountable
    • Assistant District Attorneys each handle – on average – 1,700+ cases a year.
    • The total number of court cases in FY22 exceeded 925,000.
  • Partnering with state and local agencies to implement evidence-based programs proven to end cycles of crime and violence
    • Drug Recovery Courts
    • Mental Health Courts
    • Domestic Violence Courts
    • Veterans Treatment Courts
  • Advocating for victims
    • Enforcing victim's constitutional rights
IN THE COMMUNITY
  • Improving and modernizing the investigation of complex crimes
    • Vulnerable Adult Protective Investigation Teams (VAPITs)
      • All 32 districts have VAPITs.
      • These teams are led by the local District Attorney General and include a host of state and local partnership agencies.
      • Over 11,800 referrals were reviewed in 2022 for suspected abuse. Code Ann. § 71-6-125
    • Child Protective Investigative Teams (CPITs)
      • All 32 districts have CPITs.
      • These teams include the local District Attorney General and a host of other state and local partnership agencies.
      • Over 22,300 referrals were reviewed in 2022 for suspected abuse. Code Ann. § 37-1-607
THROUGH LEGISLATION
  • Identifying the ways in which our laws aren’t promoting public safety and fighting to improve them
    • Truth In Sentencing – District Attorneys have worked, and continue to work, on ensuring violent offenders serve the entirety of their ordered sentence in an effort to give victims clarity and peace of mind over the time a defendant will actually serve behind bars.
    • Unintended Loopholes – When District Attorneys identify ways to improve laws and bring criminals to justice, they work alongside legislators to make this a reality. This ensures victims have a better experience throughout the court process, while providing prosecutors the tools they need to be successful.
    • Restitution for Victims – Money owed to victims used to be an afterthought. In 2020, District Attorneys worked alongside legislators to prioritize victim restitution in the list of fees defendants are required to pay.
