According to CLP Regulation (Regulation (EC) No 1272/2008), CMR substances are defined as follows:

  • Carcinogenic substances and mixtures are substances and preparations which, if they are inhaled or ingested or if they penetrate the skin, may induce cancer or increase its incidence.
  • Mutagenic substances and mixtures are substances and preparations which, if they are inhaled or ingested or if they penetrate the skin, may induce heritable genetic defects or increase their incidence.
  • Substances and mixtures are toxic for reproduction if, when inhaled or ingested or penetrated through the skin, they may produce or increase the incidence of non-heritable adverse effects in the progeny and/or an impairment of male or female reproductive functions or capacity.

minimum requirement

Substances which have been classified as carcinogenic, mutagenic or reprotoxic in the CLP Regulation 1272/2008, respectively (see table) must not exceed the following percentages (m/m) in chemicals and products:

Except titanium dioxide (CAS 13463-67-7), if the product is placed on the market as a liquid mixture or as an article, as the classification of titanium dioxid refers only to inhalable dusts (powdery).

All products awarded one of the following eco labels meet these criteria:

  • natureplus quality label
  • Österreichisches Umweltzeichen (Austrian eco label)
  • Blauer Engel/Blue Angel.

Alternatively, the corresponding baubook declaration may serve as evidence (www.baubook.info/oea).

Change of criteria

Titanium dioxide has to be labelled with H351 in powdery products from 1 October 2021 if > 1wt% particles with an aerodynamic diameter of ≤10 µm are contained. Therefore, the following exemption is defined:Except titanium dioxide (CAS 13463-67-7), if the product is placed on the market as a liquid mixture, as the classification of titanium dioxid refers only to inhalable dusts (powdery).
