Biography
Anh Tu Nguyen is a senior patent executive with T&G Law Firm LLC (TGVN), a licensed law firm and IP agent that partners with Tilleke & Gibbins for local filings in Vietnam. She specializes in all aspects of patent prosecution relating to chemical, pharmaceutical, and biotech inventions. In addition to managing patent filing cases for clients, she drafts and reviews specifications and advises on cancellations, oppositions, and appeals.
Tu Anh has been working in IP law since 2001, honing her skills and relationships at one of Vietnam’s most highly regarded local firms prior to joining TGVN. Before beginning her law career, Tu Anh worked as a scientist for four years at Vinabeco’s Research Institute of Brewing, where she studied manufacturing processes for beer, wine, and other alcoholic beverages.

- Performed research related to obligations/requirements to disclose the source or origin of genetic resources or biological material in patent applications, management of genetic resources, and procedures for access to genetic resources/prior informed consent.

Decree to Implement Vietnam’s Amended IP Law to Be Issued by Year-End
On June 16, 2022, Vietnam’s National Assembly ratified the latest amendment of the country’s Intellectual Property Law, which will take effect on January 1, 2023 (except for the provisions on sound marks, which took retroactive effect on January 14, 2022, and the provisions on test data protection for agrochemicals, which will come into force on January 14, 2024). For the amended IP Law to be enforced consistently and efficiently, the government is actively working to issue a decree guiding the implementation of the amended IP Law (the “new decree”). The new decree, after being ratified, will also take effect on January 1, 2023, replacing Decree No. 103/2006/ND-CP and Decree No. 105/2006/ND-CP, two decrees issued in 2006 to guide the previous IP Law of 2005. Due to the urgency of promulgating a legislative document conforming with the amended IP Law when it takes effect, the government will formulate and promulgate the new decree under a simplified procedure. The drafting agency circulated the first draft of the new decree to seek opinions from concerned parties on October 10, 2022. The new decree is seen as comprehensive guidance to key aspects of the IP Law, including the establishment and enforcement of industrial property rights, IP representation, measures to promote IP activities, IP-related export and import control; IP assessment, and state management of intellectual property. The new decree generally consolidates provisions of the two previous decrees without many changes. Tilleke & Gibbins Creates IP Guides for Cambodia, Indonesia, Thailand, and Vietnam for EU-Funded Project
Intellectual property experts from Tilleke & Gibbins were engaged by ARISE+ IPR, a regional support program funded by the European Union and implemented by the European Intellectual Property Office, to craft a series of IP enforcement guides for Southeast Asian countries, aimed at raising local awareness of the importance of IP protection. The five-year, EUR 5.5 million ARISE+ IPR program supports regional integration through IP cooperation and aims to upgrade national IP systems for creation, protection, utilization, administration, and enforcement to be in line with international best practices and standards and the strategic objectives of the ASEAN Intellectual Property Rights Action Plan 2016-2025. IP Office Extends Deadlines as Vietnam Battles Fourth Wave of Covid-19
As Vietnam continues to fight the latest wave of the Covid-19 pandemic with strict social distancing measures, the Intellectual Property Office of Vietnam (IP Office) has issued Notice No. 7581/TB-SHTT dated August 2, 2021 (Notice 7581), extending certain deadlines for IP applicants. The contents of Notice 7581 are similar to those found in Notice 5277 issued in March 2020 during the first wave of the pandemic. Specifically, Notice 7581 reads as follows: All procedures related to procedures to establish industrial property rights (priority claims, supplementation of documents, responses to the IP Office’s decisions/notifications, renewal and extension of the validity of protection titles, payment of fees and charges, and filing of appeal petitions) falling due during the period from June 30, 2021, to the end of August 31, 2021, will automatically be extended to the end of September 30, 2021. For other cases, if an applicant is still affected by the Covid-19 epidemic with regard to the implementation of its rights and obligations in the procedures for establishing rights to industrial property objects at the IP Office, such applicant may request [the IP Office] to apply the clauses on objective obstacles and force majeure as set out in Points 9.4 and 9.5 of Circular No. 01/2007/TT-BKHCN, as amended and supplemented by Circular No. 16/2016/TT-BKHCN. Observations on the Content of Notice 7581 As with last year’s Notice 5277, it is worth noting that the wording of Notice 7581 covers only the procedures to “establish industrial property rights,” rather than all aspects of industrial property rights.
