Bridging Visa C (BVC) Subclass 030 - E-HELP CONSULTANCY ...
The Bridging Visa C (BVC), or subclass 030, is a temporary visa for non-citizens who have overstayed their last visa and have filed an application for an eligible substantive visa. This visa has been framed to allow such applicants who have filed a valid substantive visa application to make their remaining stay in Australia lawful while they await a final decision on their visa. Subclass 030 does not give you travel rights even if you are holding a BVC, which means if you leave Australia, you might not be allowed to return.
If an individual remains in Australia without a valid visa, they become an unlawful non-citizen (UNC) for that duration of time. Being an unlawful non-citizen (UNC) in Australia might have an adverse effect on future citizenship and visa applications.
How does a Subclass 030 Bridging Visa C Work
The subclass 030 or BVC might be granted if an individual files an application in Australia for a valid substantive visa while their previous substantive visa has expired. It allows them to reside lawfully in Australia until a final decision is taken on their substantive visa application.
Understanding substantive visa: All visas are substantive except a bridging visa, or a criminal justice visa, or an enforcement visa.
A BVC is granted depending on your situation, if you apply for a valid substantive visa, your BVC is granted automatically, or alternatively, one can also apply through a special form. The Department will communicate if they simultaneously grant a BVC; in that case, a separating filing would not be required.
For instance, the validity of a visitor visa (subclass 600) has expired, and the possessor of the visa became aware of it after the visa expiry date. To avoid getting into trouble, the visa holder immediately makes a valid application for another eligible substantive visa. The BVC would be granted to the applicant simultaneously to permit a lawful stay until a decision on the newly filed visa application is made.
Subclass 030 or the Bridging visa C does not come with any travel rights, nor is an applicant allowed to apply for a subclass 020 or the Bridging visa B to avail travelling rights. A Bridging visa C holder can not leave Australia on this visa; in case a necessity arises, the applicant will be required to contact the Department for the same.
A subclass 030 Bridging visa C also provides its holder with an opportunity to work if the applicant can demonstrate that they are facing financial hardship. An applicant might be permitted to undertake work in Australia based on the visa conditions that apply to their BVC. Some of the substantive SkillSelect visas applied for, such as subclass 132 (Business Talent), Subclass 186 (Employer Nomination Scheme) visas, come with working rights. If the existing BVC does not permit work or has restrictions on working, one can apply for another BVC that allows an applicant to undertake work. To apply for a BVC that permits work, one will have to demonstrate that they are undergoing financial trouble.
