Data privacy enforcement in Taiwan, Macau, and China

Partner Chen Hui-ling contributed an analysis of Taiwanese data privacy enforcement in Issue 116 of  the Privacy Laws & Business International Report (June 2012) in an article entitled “Data privacy enforcement in Taiwan, Macau, and China.” The article was co-authored by Chen and Graham Greenleaf of the University of South Wales. In the Taiwan section of the article, Chen focuses on how the Taiwan Financial Supervisory Commission has used its regulatory power to penalize banks and insurers who failed to implement data controls leading to disclosures of personal information. Meanwhile, the Ministry of Justice said in early June that the long-delayed Personal Information Protection Act would become  operative in October with the exceptions of Article 6 (sensitive personal information) and 54 (notification). These controversial articles will be held back so that they can be amended. The draft bill to amend the PIPA has been drafted by the Ministry and is currently being reviewed by the Executive Yuan.
