Summary/Abstract: Article 2 para. (2) of the Council Framework Decision 2002/584/ HA of June 13, 2002, on the European arrest warrant and the surrender procedures between the Member States must be interpreted as meaning that, in order to verify whether the offense for which an European arrest warrant is punishable by the issuing Member State by a custodial sentence or a security measure of a maximum duration of at least three years, as defined in the law of the issuing Member State, the executing judicial authority must take into consideration the law of the issuing Member State, in the version applicable to the facts giving rise to the case in which the European arrest warrant was issued.
