The European Court of Justice (ECJ) March 10 issued an advocate general opinion for Case No. C-538/20, clarifying German tax deduction rules. A German company had a branch in the U.K. since 2004. The company decided to cease operations in the U.K. branch in 2007. The German tax authority disallowed the deductions, asserting that losses incurred in the U.K. are no longer eligible for set-off under the 2010 DTA.
