Goh Hui Hua

Associate Director

Hui Hua started his legal career as a part-called trainee who appeared extensively before the courts. After being called to the Singapore Bar in 2017, Hui Hua acted and continues to act as lead counsel for various general litigation matters (including a matter wherein a judgment was successfully obtained for a sum of approximately S$6.3 million). As a result, Hui Hua is armed with significant on-the-ground advocacy experience right from the start of his legal career, having conducted cross-examination in the District Court and argued before High Court Judges since his first year of practice.

Hui Hua’s experience has allowed him to provide holistic solutions to his clients which take into account the legal aspects, as well as the commercial and practical considerations, of each matter.

  • Acted as lead counsel for Third Party Claimants in claiming beneficial interests in a landed property (valued at approximately S$4,800,000) which was sought to be included as part of matrimonial assets to be divided in Divorce Ancillary Matters.

  • Advising a Claimant on purchasing the interests of the other co-owners of a shophouse property (valued at approximately S$4,500,000).

  • Representing a Defendant Wife to resist a court-ordered sale of the matrimonial landed property (valued at approximately S$4,000,000) which is in the joint names of the Claimant Husband and the Co-Defendant Daughter on the basis of a Deserted Wife’s Equity, proprietary and promissory estoppel, a contractual license under a will, and the Su Emmanuel test.

  • Acted as lead counsel in obtaining a local freezing injunction against 3 defendants (i.e. prohibiting the disposal of their assets worldwide up to the value of USD 1,217,000) in the High Court in a claim on the grounds of conspiracy by lawful or unlawful means, breach of fiduciary duties, knowing receipt, dishonest assistance, breach of contract and unjust enrichment relating to an overseas property investment scheme.

  • Acted as lead counsel in advising on the wrongful termination of an agreement to engage the client as a developer of a cryptocurrency protocol under the Solana blockchain whereby payment for the engagement was to be made in cryptocurrency.

  • Represented a company listed on the Mainboard of the Singapore Stock Exchange in a series of lawsuits involving issues relating to the issue of Performance Shares, and misrepresentations leading to the entering of a sale and purchase agreement over a Company.

  • Represented a tuition business owner and his company in a High Court lawsuit involving issues of contractual interpretation, director’s duties, passing off and conspiracy (Tuitiongenius Pte Ltd v Toh Yew Keat and another [2020] 5 SLR 354; [2019] SGHC 264).

  • Acted as lead counsel in advising a top-performing trader who left his previous employer for a competitor on the enforceability of restraint of trade and confidentiality clauses in his previous employment contract.

  • Advised an engineering solutions company on claims to be made against errant employees and suppliers who conspired to derive kickbacks from purchases made by the company.

  • Represented a company in claiming for damage to brand equity and losses sustained in mitigating such damage arising out of breaches of employee and fiduciary duties on part of a previous employee.

  • Acted as lead counsel in enforcing a foreign divorce agreement and order relating to the division of a Singapore condominium (valued at approximately S$1,400,000).

  • Acted as lead counsel in seeking to include an HDB Flat (valued at approximately S$630,000) and a Commercial Property (valued at approximately S$680,000 as part of the matrimonial pool of assets to be divided in the Divorce Ancillary Matters via Third-Party Interests Proceedings in the General Division of the High Court).

  • Acted as lead counsel in enforcing a maintenance order against a defaulting Respondent who was working within an international organisation and obtained an order for imprisonment if the Respondent continued to default in making maintenance payments in the following months.

Probate & Estate Administration

  • Acted as lead counsel in a High Court application to declare a procedurally irregular CPF nomination as legally valid and to restrain the CPF Board from disbursing the CPF funds pending the determination of the matter by the High Court (Toh Tun Li Adeline v Central Provident Fund Board and another [2023] SGHC 55).

  • Acted as lead counsel for Deputies in obtaining approval from the Family Justice Courts to make a statutory will for a mentally incapacitated person.

  • Representing Executors in admitting a copy of a Last Will and Testament for purposes of obtaining the Grant of Probate in circumstances where the original Last Will and Testament could not be found.

  • Represented an appellant in an Appeal against the Council of Estate Agents’ refusal to renew the license of a real estate agent.

Cross-Border Matters

  • Acted as lead counsel in a High Court application to set aside an order granting leave to enforce a Singapore International Arbitration Centre arbitration award of approximately USD 7,000,000 on grounds of breach of natural justice and fraud.

  • Represented a Plaintiff in a claim for approximately USD 24,000,000 involving conflicts of law issues crossing over the jurisdictions of New York, Delaware, and Mauritius.

  • Acted as lead counsel in advising on the intended enforcement of a foreign judgment amounting to approximately €21,500,000 against a Sovereign State.

Restructuring & Insolvency

  • Represented Liquidators in an application by funding creditors to obtain priority over other creditors pursuant to Section 328(10) of the Companies Act.

  • Represented the Liquidator in an action to void a charge and claw back transactions based on Section 330 of the Companies Act and/or unfair preference and/or transaction at an undervalue.
