A hearing in the First Chamber of the EU Court of Justice today concerning the position of the Data Protection Officer. According to Article 38(3) of the GDPR a Data Protection Officer (DPO) may not be dismissed or penalised for performing her or his tasks. The question discussed today is whether the GDPR allows national law (in this case German law) to give more protection to the position of the DPO by laying down that the employment contract of the person functioning as DPO may only be terminated for serious reasons. A question about the level of harmonisation brought about by the #GDPR on this point (C-534/20). Also on the agenda today: the opinions of Advocate-General Campos Sánchez-Bordona in several cases concerning retention of telecom data (C-793/19, C-794/19, C-140/20, C-339/20 and C-397/20).
