About us
Founded in 1969, the National Health Law Program protects and advances the health rights of low income and underserved individuals. NHeLP advocates, educates and litigates at the federal and state level. Our lawyers and policy analysts stand up for the rights of the millions of people who struggle to access affordable, quality health care. We are guided by the belief—a challenge—that each generation should live better than the last. Health care reform offers the opportunity to substantially reduce the number of uninsured and improve access to care, including through the law’s expansion of the Medicaid program. Political and economic challenges, however, threaten these advances for millions of low-income and uninsured people. NHeLP defends the nation’s health care safety net for those most in need and those with the fewest resources. We fight to give at-risk populations a voice in federal policy making, promote the rights of consumers in emerging managed-care systems, and advocate for creative solutions that preserve the government’s responsibility as the provider of last resort. We are a force in the courtroom, working to ensure that low-income people and underserved communities can obtain the quality care to which they are legally entitled and holding state and federal Medicaid agencies accountable for their programs. Timely Tip #7: STRONG EXEMPTION POLICIES CAN REDUCE THE HARM FROM UPCOMING WORK REQUIREMENTS. Advocates should push states to proactively identify exempt individuals, apply longer-term exemptions, avoid narrow definitions, and use clear screening language so eligible people aren’t wrongly subjected to work rules. The Trump Administration has taken aggressive federal action to gut the Medicaid program and Marketplace coverage across the country. There are numerous provisions from the Marketplace Final Rule and H.R.1, the so-called “One Big Beautiful Bill Act” (OBBBA) that drastically erode over a decade of progress to expand access to health coverage and improve health care affordability through Marketplace coverage. In California, consumers who rely on Covered California for health insurance coverage are starting to feel the harm. Californians are paying the price for these harmful federal changes. HHS requested information on supporting innovation and use of artificial intelligence (AI) in clinical care. NHeLP's response highlights the abundant research that discusses how AI in health care can exacerbate bias and lead to improper, harmful decisions. NHeLP's comments also discussed how our experience with AI and the research shows that the risk with AI in health care is high, and certain protections like transparency and accountability are key to public trust and patient safety with the use of AI. At a time when health care costs are skyrocketing, Congress should be supporting communities by strengthening Medicaid, restoring and extending enhanced premium tax credits for Marketplace coverage, as well as ensuring access to preventive, sexual, and reproductive health care. Instead, through H.R. 1, President Trump and his allies in Congress cut Medicaid, Medicare, the Children’s Health Insurance Program (CHIP), and Marketplace coverage by more than a trillion dollars, dramatically expanding funding for Immigration and Customs Enforcement (ICE) and Customs and Border Protection’s (CBP) violent mass deportation, detention, family separation, and anti-democracy efforts. In a letter organized by Planned Parenthood Federation of America and the National Health Law Program, 135 health advocacy organizations and allied groups urged Congress to prioritize health care access over funding weaponized immigration agencies wreaking havoc in our communities. The sweeping Medicaid changes under OBBBA will strain state systems, increase red tape, and risk harmful coverage losses, especially for people with disabilities. With rushed timelines and $990M in cuts, failures are inevitable. States must build strong safeguards and a “landing pad” to quickly fix errors and protect enrollees. NHeLP submitted comments opposing two proposed rules from HHS that would prohibit the use of federal Medicaid funding for coverage of gender-affirming care for minors and prohibit, as a condition of participation, Medicare and Medicaid hospitals from providing gender-affirming care to minors. In these comments, NHeLP urges HHS to withdraw the rules because they are inconsistent with federal law, are not based on the best available evidence and data, and will cause harm to the health of minors with gender dysphoria.
