Sommaire

1 Une clause attributive de juridiction, qui est insérée sans avoir fait l'objet d'une négociation individuelle dans un contrat conclu entre un consommateur et un professionnel et qui confère compétence exclusive au tribunal dans le ressort duquel est situé le siège du professionnel, doit être considérée comme abusive au sens de l'article 3 de la directive 93/13, concernant les clauses abusives dans les contrats conclus avec les consommateurs, dans la mesure où elle crée, en dépit de l'exigence de bonne foi, au détriment du consommateur un déséquilibre significatif entre les droits et les obligations des parties découlant du contrat.

2 La protection que la directive 93/13, concernant les clauses abusives dans les contrats conclus avec les consommateurs, assure à ceux-ci implique que le juge national puisse apprécier d'office le caractère abusif d'une clause du contrat qui lui est soumis lorsqu'il examine la recevabilité d'une demande introduite devant les juridictions nationales.

La juridiction nationale est tenue, lorsqu'elle applique des dispositions de droit national antérieures ou postérieures à ladite directive, de les interpréter, dans toute la mesure du possible, à la lumière du texte et de la finalité de cette directive. L'exigence d'une interprétation conforme requiert en particulier que le juge national privilégie celle qui lui permettra de refuser d'office d'assumer une compétence qui lui est attribuée en vertu d'une clause abusive.
