Luật sư Nguyễn Mạnh Dũng được đào tạo về Luật hàng hải quốc tế tại Sinclair Roche & Temperley, một hãng luật hàng hải của Anh từ những năm 1993-1997 và sau đó nghiên cứu sau đại học (LL.M) về Giải quyết tranh chấp thương mại quốc tế mà đặc biệt là Trọng tài thương mại, Trọng tài đầu tư, Tranh tụng thương mại quốc tế và Hòa giải thương mại tại Trường Trọng tài quốc tế (SIA) thuộc trường Luật Queen Mary, Đại học tổng hợp Luân Đôn (Anh) năm 2007-2008 được giảng dạy trực tiếp bởi các Giáo sư Luật nổi tiếng của Anh là Julian Lew, QC và Loukas Mistelis, đều là Trọng tài viên của ICSID.Ông là luật sư Việt nam đầu tiên được công nhận là Thành viên của Viện trọng tài Anh (MCIArb) từ 21/04/2009 và trở thành Thành viên Việt nam đầu tiên tại Tòa trọng tài quốc tế ICC liên tiếp 2 nhiệm kỳ từ 1/7/2017 đến 30/06/2021. Luật sư Nguyễn Mạnh Dũng trực tiếp tham gia biên tập và soạn thảo Luật trọng tài thương mại năm 2010, Nghị định 22/CP về Hòa giải thương mại cũng như Bộ luật tố tụng dân sự năm 2015 về công nhận và thi hành phán quyết trọng tài nước ngoài cũng như công nhận thỏa thuận hòa giải ngoài tòa án và các văn bản hướng dẫn thi hành tạo nên khuôn khổ pháp lý nền tảng cho sự phát triển của lĩnh vực trọng tài và hòa giải thương mại ở Việt nam. Ông là Phó chủ tịch Hội đồng khoa học và Trọng tài viên của Trung tâm trọng tài quốc tế Việt nam (VIAC), Ủy ban trọng tài thương mại Hàn quốc (KCAB International), Tòa trọng tài quốc tế Hải Nam (HIAC) & Ủy ban Trọng tài Thượng Hải của Trung quốc cũng như Trung tâm Trọng tài quốc tế Hồng Kong (HKIAC) và Phòng trọng tài hàng hải Singapore (SCMA) đồng thời là Hòa giải viên của Trung tâm hòa giải Việt nam (VMC), Trung tâm Hòa giải liên kết giữa Hồng Kong và Trung quốc (MHJMC), Trung tâm hòa giải quốc tế Nhật bản (JIMC) ở Kyoto và Trung tâm hòa giải quốc tế thuộc Tòa trọng tài quốc tế Hải Nam (HIAC) của Trung quốc. Trọng tài viên Nguyễn Mạnh Dũng trên các cương vị là thành viên, chủ tịch Hội đồng trọng tài và Trọng tài viên duy nhất đã trực tiếp xét xử theo các quy tắc trọng tài trong nước và quốc tế các tranh chấp về hợp đồng dịch vụ, cung ứng, phân phối, mua bán hàng hóa quốc tế, hợp đồng vay, hợp đồng liên doanh, hợp tác kinh doanh, hợp đồng vận chuyển hàng hóa bằng đường biển, hợp đồng bảo hiểm hàng hải, xây dựng, mua bán và sát nhập (M&A), dầu khí và khai khoáng vv. đồng thời tham gia giảng dạy về Trọng tài và Hòa giải tại Học viên Ngoại giao (DAV) và Học viện tư pháp, được mời là chuyên gia nghiên cứu của các tổ chức quốc tế nâng cao năng lực cho các tổ chức tài phán ở Việt nam, diễn giả tại nhiều diễn đàn khoa học khác nhau.Thư viện điện tử này tập hợp các ấn phẩm đã công bố hay xuất bản trong nước và quốc tế nhằm mục đích duy nhất là thúc đẩy việc học tập, nghiên cứu và giảng dạy luật quốc tế mà Luật sư Nguyễn Mạnh Dũng trực tiếp hay gián tiếp tham gia với tư cách là tác giả cũng với các đồng nghiệp tại Công ty Luật TNHH Tư vấn Độc Lập (Dzungsrt & Associates LLC). However, due to the lack of consistent and uniform understanding of Vietnam’s legal regulations and New York Convention 1958, the procedures for recognition and enforcement of foreign arbitral awards have not been consistent at Courts to gain absolute trust of investors. With the Vietnam Civil Procedural Code promulgated in 2015, various former law issues have been overcome and the consistency between Vietnamese legislative and regulatory framework and regulations of New York Convention 1958 which Vietnam officially joined in 1995 has been ensured. The roles of the courts in promoting Alternative Dispute Resolution (ADR) measures were more clearly provided for in the new Code, covering arbitration and mediation. It was provided in more details in the Code about the Court’s support of arbitration proceedings during the arbitration process and the Court’s recognition of out-of-Court mediated settlement agreements so that such agreements can be enforceable as Court judgments or decisions.The Judicial Manual on Arbitration and Mediation has been jointly developed by international and national experts within the scope of operation between the Supreme People’s Court and International Finance Corporation (IFC) to provide reference information for Judges and to ensure consistency in the application of the law to resolve requests for recognition and enforcement of foreign arbitral awards, for setting aside arbitral awards, for the support of arbitration operations, and for recognition of mediated settlement agreements, etc. when applying new regulations in the Civil Procedural Code 2015.
