The European Union Official Gazette Jan. 18 published European Court of Justice (ECJ) Preliminary Ruling No. C-734/19, on Romanian input VAT deduction rules for real estate companies. A taxpayer deducted input VAT on two redevelopment projects, which were subsequently liquidated. The tax authority imposed VAT under an audit, denying the deductions because the taxpayer was aware of the first project’s possible non-completion due to noncompliance with local rules, and a commission agent was responsible for collecting VAT on the second project.
