Biography
Thuy Thi Ngoc Huynh is an associate with T&G Law Firm LLC (TGVN), a licensed law firm and IP agent that partners with Tilleke & Gibbins for local filings in Vietnam. Based in the Ho Chi Minh City office, she has worked in the enforcement field since 2008, actively helping clients in sectors ranging from fashion to cosmetics to auto parts to protect their valuable intellectual property from counterfeiting and infringement in Vietnam.
Thuy has a wide range of experience, both in the field and behind the desk, and serves an especially key role as an interface between the firm’s investigation team and overseas brand owners, skillfully transforming the collected results of assorted market surveys into concise yet comprehensive reports, analyzing seriousness of infringements, and giving advice on enforcement actions.
Experience
- Assisted an American stuffed toy manufacturer in a trademark infringement case that resulted in the infringer’s voluntary withdrawal and destruction of over 300 units of the infringing products.
- Regularly conducts in-person training presentations for customs and enforcement authorities throughout Vietnam on identifying and distinguishing counterfeit and genuine goods on behalf of clients in various industry sectors, including cosmetics and electronics.
- Assisted a Japanese pharmaceutical company in a trademark infringement case, in which the infringer ceased making the product bearing the infringing mark. Significantly, the infringer voluntarily withdrew their application for the infringing mark before the Vietnam IP Office.
- Advised and assisted multiple fashion, cosmetics, and auto manufacturers in actions against trademark infringement and counterfeit goods, resulting in the seizure and destruction of these products, heavy sanctions imposed on the infringers, and suspension of their business activities for several months.
- Assisted multiple clients in retrieving domain names, including amicably negotiating with an individual to return a domain name without any reimbursement, and persuading another individual to voluntarily surrender an infringing domain name to the registrar so our client could register it after expiration.
- Regularly advises clients on border measures such as customs recordal, customs seizure, and customs searches.
- Successfully dealt with a company which used pirated software, and then agreed to purchase licensed software from our client.
- Successfully worked with numerous infringers to force them to hand over inventories of IP-infringing goods.

Vietnam Enacts Landmark IP Law Amendments
Vietnam’s National Assembly approved wide-ranging amendments to the Intellectual Property (IP) Law on December 10, 2025, marking one of the most significant overhauls of the country’s IP regime in recent years. The changes, which supplement and refine existing provisions, are designed to align Vietnam’s framework more closely with international standards while addressing practical challenges faced by rights holders and practitioners. The amendments will come into force on April 1, 2026. The most notable changes are detailed below. Recognition of partial and nonphysical industrial designs: Industrial design protection has been broadened to cover partial designs and nonphysical forms (class 32), explicitly extending rights to parts of products that are not independently circulated as well as digital and intangible product appearances. The law clarifies that the external appearances of nonphysical products are protected industrial designs, and circulation of digital copies of any part of that appearance will be treated as an act of using the industrial design. The provision on the industrial applicability of industrial designs has also been amended accordingly to include the uniform reproduction of nonphysical products in cyberspace. Resolving conflicts between overlapping rights: The IP Law provides a safeguard against conflicts when a single subject matter is protected by multiple IP rights. Where overlapping rights exist, the later-arising right will be terminated if its exercise interferes with the normal exploitation of an earlier right. The decision to terminate such a later right rests with the court. Use of published data for AI training: Organizations and individuals may use lawfully published and publicly accessible documents and data for scientific research, testing, and AI system training. Major Legal Changes Impacting Vietnam’s IP Regime: 2025 Legislative Updates
Over the first half of 2025, the government of Vietnam has implemented a comprehensive suite of legislative reforms that significantly impact the country’s intellectual property (IP) framework. These amendments, most of which took effect on 1 July 2025, span the criminal, civil, administrative, and judicial sectors, and are part of a broader initiative to modernize Vietnam’s legal infrastructure, strengthen enforcement mechanisms, and harmonize domestic regulations with international standards. A summary of the key legislative changes and their potential implications for IP protection and enforcement across Vietnam is provided below. Criminal Code: Stricter penalties Under the 2025 amendments to Vietnam’s Criminal Code, penalties for offenses involving the manufacturing and trading of counterfeit goods have been significantly escalated. Individuals convicted of such violations now face fines ranging from VND 200 million to VND 2 billion (approximately USD 7,700 to USD 77,000; up from VND 100 million to VND 1 billion). For corporate entities, the penalties are even more severe, with fines ranging from VND 2 billion to VND 40 billion (roughly USD 77,000 to USD 1.54 million; up from VND 1 billion to VND 20 billion). Vietnam Issues New Decree on Administrative Sanctions in Industrial Property
On May 4, 2024, the Vietnamese government issued Decree No. 46/2024/ND-CP (“Decree 46”) amending and supplementing certain articles of Decree No. 99/2013/ND-CP dated August 29, 2013, on administrative sanctions in industrial property, as amended and supplemented in 2021 (“Decree 99”). Decree 46, which will come into force on July 1, 2024, is designed to bring Decree 99 in line with the amended IP Law of 2022. Some of the notable amendments of Decree 46 are discussed below. New Infringing Acts Decree 46 added the following new infringing acts subject to sanctions, which had not been set out in the former decree: Use of patents, utility solutions, layout designs, or industrial designs without paying compensation according to the provisions on temporary rights specified in Article 131 of the amended IP Law. Accepting a trademark license not in the form of a written contract in the case of using the licensed trademark on goods or packaging. Failure to notify clients of costs, charges, and fees related to procedures for establishing and protecting industrial property rights. Deceiving clients in the course of entering into and performing industrial property representative service contracts, but not to the extent of criminal prosecution, or forcing customers to enter into and perform industrial property representative service contracts.
